General Terms and Conditions
Our General Terms and Conditions are the basis for any legal relationship between Handelswerk GmbH and its customers, who are placing orders using our Internet-Shop, via email, fax, letter or phone. These General Terms and Conditions comply with the german and european legal requirements regarding distance selling act, customer information and the right to return products.
1. Area of Application
Our terms and conditions apply to all contracts we close with you as our customer. The customers conditions of purchase or any other terms and conditions of business shall not be applicable.
2. Conclusion of Contract
Our product presentation within the internet or any other media does not represent a binding offer, but an invitation to place an order. While adding product to your cart and clicking the button "Submit Order" you place a legally binding order. A purchse contract is concluded if we ship the ordered goods within 2 weeks or if we send a confirmation of the order.
We store the wording of the contract (order and invoice) in our system. Details about your order will be send in an acknowledgement of receipt right after placing the order with us in an email. The invoice will be send together with the ordered goods.
3. Right of Cancellation

You have the right to declare your revocation of the purchase contract in text form (e.g. letter, email, fax) or also by returning the products within a period of fourteen (14) days without indicating any reasons. This time period starts to run upon receipt of these instructions in text form, but not prior to receipt of the goods by the recipient, and also not before we comply with our duties to provide information pursuant to article 246 § 2 in conjunction with § 1 section 1 and 2 EGBGB and our duty pursuant § 312g section 1 sentence 1 BGB in conjunction with article 246 § 3 EGBGB. To meet the time limit it's sufficient to send off the cancellation notice or goods in time. The revocation or the return has to be send to:

Cancellation Consequences
In the event of an effective cancellation, the mutually received goods or benefits have to be returned and - if applicable - any additional benefits (e.g. compensation for use) have to be returned. In the event that you cannot return the received products completely, but only partially or in a damaged or incomplete condition (e.g. missing accessories, packaging material or product is broken) a compensation for the value may be demanded. This does not apply if a deterioration of a product is only caused by the inspection of the product features and mode of operation – such as would have been possible e.g. in a retail shop where you can test the product. You can avoid an obligation to compensate a value caused by the deterioration of the products by not making use of the items as if you already owned them and refrains from doing anything what could decrease the value of the product.
If the products could be send in a parcel, returns are shipped back to us under our risk.
You have to pay for the regularly return shipping costs if the products received are in conformity with those ordered, and if the price of the products returned does not exceed an amount of 40 Euros. If the price for the returned products is higher you also have to pay for the return shipping costs if, at the point of revocation, you haven't paid what has been agreed upon the contract before, including partial payments. In any other case the return of the products is free of all forwarding costs.
If products cannot be returned as a parcel they will be collected from your address. Obligatons to refund payments must be fulfilled within 30 days. This period starts to run for you with the date when you declare your revocation or with the returning of the product. For us it starts once we receive the notice or products.

4. Return charges
If you use the right of revocation, you have to pay for the return shipping costs if the products received are in conformity with those ordered, and if the price of the products returned does not exceed an amount of 40 Euros. If the price for the returned products is higher you also have to pay for the return shipping costs if, at the point of revocation, you haven't paid what has been agreed upon the contract before, including agreed parial payments.
In any other case the return of the products is free of all forwarding costs for you, means we refund arising forwarding expenses or, if you send a short note before you dispatch the product, we'll send a prepaid return label which can be used for shipping.
5. Warranty
If a product is damaged (incl. damages in transit) when it arrives or has a defect, we'll take care for corrective actions, pursuant to the statutory provisions, immediately and service orientated.
For this purpose contact us first (e.g. while sending an email.
Please inform us about the product and kind of defect. We'll take care for a replacement or if applicable for an alternative solution. In case of a replacement delivery we'll take care for all return and forwarding costs. Please, don't send anything back without sufficient stamps.
6. Price, Product and Delivery changes
All prices are including german VAT plus shipping charges. We reserve the right not to accept an order or not to ship e.g. because of missing availability. In such a case we'll inform you immediately and refund all already made payments.
7. Payment and Delivery
Based on the country of delivery different kind of payments are possible. The complete order amount is the sum of all product prices plus shipping costs. There is no possibility to get any trade discount e.g. by down-payments or direct debit.
On working days (monday to friday excluding public holidays in Germany) we ship all paid (until noon) orders the same day. Orders paid after noon will be shipped the next working day.
8. Reservation of Title
All delivered products shall remain in our property until the purchase price has been paid full. It's independent from the cancellation period.
9. Applicable Law
Contract languages are German and English.
